Terms of Service

These Terms of Service ("Terms") govern your access to and use of Uptik, a smart uptime and SSL monitoring service provided by PopData Software e Consultoria Ltda. (CNPJ 07.390.623/0001-67, "Uptik", "we", "us"). By creating an account or using the service, you agree to these Terms.

1. Description of Service

Uptik monitors the availability and security of domains and hosts registered by you or your organization, including:

• Uptime checks for websites, APIs, and TCP ports.
• SSL certificate validity and expiration monitoring.
• Domain registration (WHOIS) expiration monitoring.
• Alerts sent via Email and Telegram when an incident is detected.

2. Plans and Pricing

Uptik is provided free of charge until January 1, 2027. Starting on that date, a fee of $9.00 USD/month applies to accounts monitoring between 100 and 1,000 hosts. Accounts monitoring more than 1,000 hosts require a custom plan; contact us to arrange pricing and terms suited to your scale. We may update pricing or plan limits at any time, with reasonable notice published on this page or communicated to registered account contacts.

3. Account Registration and Security

• You must provide accurate information when creating an account, including via Google sign-in.
• You are responsible for keeping your credentials confidential and for all activity under your account.
• You may invite other users to collaborate on a company account; you are responsible for the access granted to invited members.

4. Acceptable Use

When using Uptik, you agree not to:

• Monitor domains or hosts you do not own or are not authorized to monitor.
• Use the service to attack, overload, or disrupt third-party systems.
• Attempt to circumvent plan limits, security controls, or reverse engineer the platform.
• Use the service for any unlawful purpose.

5. Notifications

Alerts about incidents, SSL expiration, and domain registration expiration are sent to the notification channels (email addresses and Telegram chats) that you configure. You are responsible for keeping these destinations accurate and active.

6. Service Availability

We strive to keep Uptik available and accurate, but monitoring checks depend on network conditions, third-party infrastructure, and the monitored systems themselves. We do not guarantee uninterrupted monitoring, and alerts may be delayed or occasionally missed due to factors outside our control.

7. Data and Privacy

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms.

8. Limitation of Liability

To the maximum extent permitted by law, Uptik and PopData Software e Consultoria Ltda. shall not be liable for indirect, incidental, or consequential damages, including loss of revenue or business interruption, arising from the use of or inability to use the service.

9. Termination

You may stop using the service and request account deletion at any time. We may suspend or terminate accounts that violate these Terms or applicable law.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of Uptik after changes are published constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Brazil, without regard to conflict of law principles.
